These terms govern your use of Aloud ("the app"), operated by Mykola Kildau ("we"). By downloading or using Aloud, you agree to them. If you do not agree, please do not use the app.
Aloud is an alarm clock. When your alarm rings, it stops when you speak your chosen sentence out loud, or type it if you selected Type mode. It is a tool for building a morning practice. It is not a medical device, a therapy product, or a substitute for professional advice of any kind.
We grant you a personal, non-exclusive, non-transferable license to use Aloud on Apple devices that you own or control, in accordance with Apple's Media Services Terms and Conditions. You may not copy, modify, distribute, sell, reverse-engineer, or lease any part of the app.
Aloud requires an auto-renewing subscription after a free trial.
If your subscription lapses, an alarm already scheduled for the coming morning will still ring and complete normally before the app asks you to renew.
Please do not make Aloud your only alarm for anything critical — a flight, an exam, a shift, medication. No app can guarantee an alarm on every device in every condition.
Alarm delivery depends on your device: battery, storage, iOS version, permissions you have granted, Focus and sound settings, and system behavior outside our control. While Aloud uses Apple's system alarm framework and is built to be reliable, we cannot and do not guarantee that any alarm will sound at the scheduled time. You are responsible for backup arrangements for time-critical obligations.
During setup, Aloud invites you to sign a pact. The pact is a promise you make to yourself. It is stored only on your device, it is not an agreement with us, and it has no legal effect of any kind. Breaking it carries no consequence beyond the ones you choose to give it.
Aloud helps you say a sentence about your life every morning. We make no promises about what saying it will bring. The app's value is the practice itself: waking up and claiming your day. Any outcomes in your career, relationships, health, or finances depend on you and the world, not on the app, and we disclaim any guarantee of specific results.
You agree to use Aloud only for lawful purposes and in accordance with these terms. You will not attempt to interfere with the app's operation or circumvent its subscription mechanics.
The app, its design, name, wordmark, and all content we created belong to us. Your manifestation sentence is yours; we claim no rights over it, and as described in our Privacy Policy, we never receive it.
Aloud is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the app — including damages resulting from a missed or delayed alarm. Our total liability for any claim relating to the app is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded under the law that applies to you, including your statutory rights as a consumer.
These terms are between you and us, not with Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You can stop using Aloud at any time by deleting the app. We may terminate or suspend access to the app if you materially breach these terms. Sections 8 through 11 survive termination.
These terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory consumer laws of the country where you live.
We may update these terms as the app evolves. The current version always lives at this page, with its effective date above. Continued use after a change means you accept the updated terms.
